NotOut CRM, A CUSTOMER RELATIONSHIP MANAGEMENT SERVICE, IS PROVIDED TO YOU OR THE ENTITY THAT YOU REPRESENT (hereinafter "You" or "Your") BY THE APPLICABLE NOT OUT ENTITY LISTED HERE (hereinafter "Not out"), ACCORDING TO THE FOLLOWING TERMS AND CONDITIONS (hereinafter "Terms") IN ADDITION TO NOT OUT GENERAL TERMS OF SERVICE. USE OF NotOut CRM INDICATES YOUR ACCEPTANCE OF THE TERMS AND GENERAL TERMS OF SERVICE.

1. Acceptance of Terms

You accept these Terms and Conditions by using our website. If you do not agree, kindly refrain from using our website.

2. Utilization of Our Services

Our services may only be used for safe purposes. Unauthorized use or misuse of our services may result in the termination of your account.

3. Access to other NotOut Services

Your NotOut Account grants access to a diverse selection of NotOut Services, most of which are connected with NotOut CRM. Even if a NotOut Service is not integrated with NotOut CRM, your NotOut Account will still give you access. Please keep in mind that certain NotOut Services may be subject to particular terms of service (hereinafter referred to as "Service Specific Terms"). It is your responsibility to read, understand, and agree to these Service Specific Terms before using the NotOut Service.

4. Integrating Third-Party Applications with NotOutCRM

NotOut CRM integrates with a large number of third-party applications ("Third-Party Application(s)"), with new integrations being added on a regular basis. You can also use the accessible API to link other Third-Party Applications with NotOut CRM, as long as they support it. Please be advised that accessing and using Third-Party Applications may necessitate your agreement of their respective terms of service and privacy policies ("Third-Party Terms"). You must read, understand, and agree the Third-Party Terms before accessing or using any Third-Party Application.

5. Email Usage Guidelines.

NotOut CRM encourages the proper usage of email. If your email bounce rate exceeds the acceptable restrictions, your account may be prevented from sending any further emails. When sending commercial emails using Not Out CRM, you must follow the terms of our Anti-Spam Policy.

To protect our system from misuse, improve deliverability, and maintain our reputation, we utilize automatic systems to monitor every outgoing emails using NotOut CRM. Any violation of our policies may result in email sending limitations or the termination of your subscription.

6. Mail Integration Add-on

The Email Integration Add-On (hence referred to as the "Mail Add-On") allows users to access, browse, compose, and send emails directly from their NotOut CRM account. Depending on the configuration settings (hence "Configuration"), emails may be visible to other users inside the NotOut CRM account based on permissions given by the administrator. If the Configuration is set to "record level" or "complete," the fetched emails will be available to other users based on the administrator's permissions and may be saved as part of the NotOutCRM account. Once the Configuration is set to "record level" or "complete" and locked by the administrator, changes to this setting will require administrator authorization.

7. Usage Limitations

NotOut CRM may impose use limits depending on the subscription level you choose. You must keep your usage within the specified restrictions to ensure uninterrupted service. You acknowledge that NotOut CRM maintains the right to restrict some activities if you exceed the usage limits associated with them.

8. API Usage Terms

Integrating NotOut CRM with third-party apps using NotOut's APIs requires technical skill. You agree that faults or problems in the integration process may cause data loss or corruption. You should ensure that the integration is carried out by qualified technical personnel. NotOut CRM will not be accountable for any data loss or corruption caused by such integration issues or defects.You must not attempt to access API functionality that is not described in the API description. You acknowledge that NotOut CRM is not liable for any consequences arising from using or accessing undocumented API capabilities.

9. API Deprecation

NotOut CRM retains the right to discontinue the present version of the API, either because it is no longer supported or because a newer version becomes available. When this decision is taken, the current API version will be marked as deprecated ("Deprecated Version"). You will receive notification of deprecation via a service announcement. During the six months following the notice ("Deprecation Period"), NotOut CRM will use commercially reasonable efforts to support the Deprecated Version. However, NotOut CRM is not required to include functionality from the more recent version in the Deprecated Version. NotOut may discontinue support for the Deprecated Version during the Deprecation Period if: (i) required by law, (ii) you violate any provision of these Terms or the General Terms of Service, or (iii) NotOut CRM considers that ongoing support poses a security risk to its systems.

10. API Usage Limitations

NotOut CRM maintains the right to set usage limits on its API, such as the number of API calls, the number of records per call, bandwidth usage, and API call frequency. To ensure uninterrupted service, you must adhere to the recommended limits. You understand that if you exceed the mentioned usage limits, NotOut CRM may restrict your ability to perform certain activities. Furthermore, if usage limits are exceeded before or during the execution of an API request, the call may fail or be partially performed.

11. Account Registration

To use certain features, you may need to create an account. You are responsible for the confidentiality of your account information as well as all activities that take place under it.

12. Payment & Fees

If you subscribe to any of our paid services, you agree to pay the prices specified on our website. All payments are nonrefundable.

13. Intellectual Property

Any content found on this website, including text, graphics, logos, and software, is owned by NotOut CRM or its licensors and protected by copyright, trademark, and other laws.

14. Limitations of Liability

NotOut CRM is not liable for any direct, indirect, incidental, or consequential damages resulting from using or failing to utilize our services.

15. Changes to Terms

NotOut CRM reserves the right to amend the NotOut CRM Terms of Service. Modifications to the Terms of Utilization take effect when you utilize NotOut CRM following the release of such adjustment. These terms may be updated from time to time. Any modifications will be posted on this page, and your continuing use of the site indicates your acceptance of such changes.
